These Terms of Service ("Terms") constitute a legally binding agreement between you ("User") and 386 LLC ("Company," "we," "us," or "our") governing your access to and use of the CodeAudit platform ("Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Acceptance of Terms
By creating an account, accessing, or using the Service in any manner, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.
If you are using the Service on behalf of an organization, you represent and warrant that you have authority to bind that organization to these Terms.
2. Description of Service
CodeAudit is an AI-powered Static Application Security Testing (SAST) platform operated by 386 LLC. The Service allows users to analyze source code, files, and websites for security vulnerabilities using artificial intelligence. Results are provided for informational and security improvement purposes only and do not constitute professional legal or security consulting advice.
3. Intellectual Property Protection & Prohibited Reproduction
The Service, including but not limited to its source code, AI models, prompts, workflows, user interface design, visual layout, branding, architecture, methodologies, and all content therein, is the exclusive intellectual property of 386 LLC and is protected by United States and international copyright, trademark, trade secret, and patent laws.
By agreeing to these Terms, you expressly agree that you will not, directly or indirectly:
Copy, clone, reproduce, reverse-engineer, decompile, disassemble, or otherwise attempt to derive the source code, architecture, design, visual layout, or underlying methodology of CodeAudit or any portion thereof;
Create derivative works based on the Service, its content, AI personas, workflows, prompts, or user interface;
Use the Service's features, workflows, AI personas, branding, or content as a template, blueprint, or reference to build, develop, or launch a competing or substantially similar product or service;
Scrape, harvest, or systematically extract data, content, or proprietary information from the Service by any automated or manual means;
Sublicense, sell, resell, transfer, assign, or commercially exploit the Service or any component thereof without the express written permission of 386 LLC.
Enforcement: Any violation of this section constitutes a material breach of these Terms and may subject you to immediate account termination and civil or criminal legal action. 386 LLC expressly reserves all rights to seek injunctive relief, monetary damages, and any other remedies available at law or in equity.
4. User Accounts & Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to immediately notify 386 LLC of any unauthorized use or security breach.
You must not share account access, use automated scripts to access the Service, or use another user's account without permission.
5. Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You shall not:
- • Use the Service to analyze code or systems you do not own or have explicit authorization to test
- • Upload malware, exploits, or content designed to harm systems or users
- • Attempt to bypass, disable, or circumvent any security features of the Service
- • Use the Service in any way that could damage, overload, or impair its infrastructure
- • Use audit results to facilitate unauthorized access to third-party systems
6. User Content & Data
You retain ownership of code and content you submit to the Service. By submitting content, you grant 386 LLC a limited, non-exclusive license to process your content solely for the purpose of providing the Service. We do not sell, share, or use your submitted code to train AI models without your explicit consent.
You represent that you have all necessary rights, licenses, and permissions to submit the content you provide to the Service.
7. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. 386 LLC DOES NOT WARRANT THAT THE SERVICE IS ERROR-FREE, COMPLETE, OR THAT AUDIT RESULTS ARE COMPREHENSIVE OR FREE FROM FALSE POSITIVES OR NEGATIVES. SECURITY ANALYSIS RESULTS DO NOT GUARANTEE THE ABSENCE OF ALL VULNERABILITIES.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, 386 LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA BREACHES, OR BUSINESS INTERRUPTION, ARISING OUT OF YOUR USE OF OR INABILITY TO USE THE SERVICE.
9. Termination
386 LLC reserves the right to suspend or terminate your access to the Service at any time, with or without cause, and with or without notice, including for violations of these Terms. Upon termination, all licenses granted to you under these Terms will immediately cease.
10. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of [State], United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved exclusively through binding arbitration, except that either party may seek injunctive relief in a court of competent jurisdiction.
11. Changes to Terms
386 LLC reserves the right to modify these Terms at any time. We will provide notice of material changes by updating the "Effective" date at the top of this page and, where appropriate, notifying you by email. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
